Path to Treaty

After the historic ‘Path to Treaty’ bill passed earlier in 2023 in regional parliament in Cairns, Queensland prepares for treaty-making between Aboriginal and Torres Strait Islander peoples. Luminary is partnering with the Queensland Government via the Department of Treaty, Aboriginal and Torres Strait Islander Partnerships, Communities and the Arts to set up the foundations of the Path to Treaty Act 2023.

The Path to Treaty Act 2023 will establish a First Nations Treaty Institute and a formal Truth-Telling and Healing Inquiry.

Truth Telling & Healing Inquiry

The objectives of the Inquiry are to chronicle the history of colonisation and impacts on First Nations peoples; ‘do no harm’ in the conduct of the Inquiry by adopting the principles of free, prior and informed consent and a trauma-informed approach; promote public awareness, inform education and develop shared understandings of First Nations cultures, histories, languages and traditions; and to link with the treaty-making process and provide recommendations to inform treaty-making.

The Truth-telling and Healing Inquiry presents a unique opportunity in Queensland’s history to reframe the relationship between Aboriginal and Torres Strait Islander Queenslanders, and non-Indigenous Queenslanders.

First Nations Treaty Institute

We’re taking steps to prepare Queenslanders for treaty-making between Aboriginal and Torres Strait Islander peoples, the Queensland Government and non-Indigenous people.

For Queensland, treaty is about the Queensland Government and Aboriginal and Torres Strait Islander peoples coming together as equals to write our future together.

The First Nations Treaty Institute will co-design a treaty-making framework that sets the ground rules for treaty negotiations and will guide treaty-making in Queensland.

Why does Queensland need a treaty?

A treaty or treaties will set the foundation for a shared future between Aboriginal and Torres Strait Islander peoples and the Queensland Government. It will allow all parties to come together and negotiate a new way of working and set the foundation for a positive co-existence.

The Path to Treaty Act 2023 benefits all Queenslanders, by:

  • building a shared understanding of the past, so we can build a strong and equal future that is based on respect

  • supporting all Queenslanders to participate in a process that promotes healing, justice, and reconciliation.

First Nations Treaty Institute:

Council Members

The Treaty Institute Council Chairpersons have particular functions including convening and presiding at meetings and overseeing the establishment of advisory committees as required under the Path to Treaty Act 2023.

All Members of the First Nations Treaty Institute Council are to be Aboriginal peoples and/or Torres Strait Islander peoples.

The First Nations Treaty Institute Council must meet at least six times each year. They are also required to keep minutes of their meetings.

First Nations Treaty Institute Council Members will have cultural integrity and authority, courage and strength, impartiality and independence and lived experience as an advocate for Aboriginal peoples and/or Torres Strait Islander peoples.

  • The key responsibilities of the Council Member(s) will include:

    • to ensure the First Nations Treaty Institute performs its functions in a proper efficient and effective way, and in accordance with the Path to Treaty Act 2023

    • to develop strategies and policies for the First Nations Treaty Institute

    • undertake any other function given to the First Nations Treaty Institute Council.

  • You will need to demonstrate the following competencies:

    • Cultural integrity and authority – cultural standing and ability to support and promote community needs.

    • Courage and strength – ability to demonstrate resilience and respond to cultural pressures.

    • Impartiality and independence – ability to work free from the influence of agencies and organisations including the Government.

    • Lived experience as an advocate for Aboriginal and/or Torres Strait Islander peoples.

    In addition, the successful candidates will be able to demonstrate they meet at least one of the below capabilities:

    • Demonstrated experience and expertise in negotiation, actioning and resolving problems.

    • Demonstrated governance experience of working on a Council/Board and compliance with legislative requirements.

    • An in-depth knowledge of relevant financial systems.

    • An in-depth knowledge of the legal obligations of a Council Member.

    • Demonstrated experience in Indigenous rights and social justice.

All applications must include a resume and statement (if written of not more than 2 pages each, if video not more than 5 minutes each) that sets out how you demonstrate your abilities across the key competencies outlined in the ‘How you will be assessed for this role’ section in the downloadable PD.

Also attach a current resume, including the names and contact details of two referees - 1 professional referee who has a thorough knowledge of your work behaviour, conduct and performance within the previous two years, and 1 cultural referee.
